Seasonal staffing in Brazil does not work the way it does in many markets. There is no general-purpose short-term employment contract you can simply offer: temporary work is a defined legal regime with its own grounds, its own limits and a mandatory intermediary.

How the temporary work regime works

Temporary work is governed by Law 6,019/1974, as amended by Law 13,429/2017. The worker is not employed by your company — they are employed by a registered temporary work agency and placed with you as the taking company. That structure is required, not a commercial preference.

Only two grounds are permitted: transitory replacement of permanent staff (vacation, leave, absence) and complementary demand for services, which is where seasonal peaks sit. The contract runs up to 180 days, extendable by a further 90.

This is distinct from the CLT fixed-term contract, which creates a direct employment relationship and has different grounds and limits. Confirm with Brazilian counsel which applies to your situation before designing the operation — the choice affects your obligations, not just your paperwork.

Why lead time matters more than anything else

Peaks are regional and synchronised. Every operator in the same logistics corridor hires in the same weeks, so starting late means competing for a candidate pool that has already been drawn down.

Lead time also buys margin for the steps that cannot be compressed: pre-admission occupational health examinations, document verification, and function-specific certifications with expiry dates. Late starts consume all three margins at once.

Peak staffing as calibration

The most underused benefit is assessment under real conditions. By the end of a peak you know who showed up every day, who learned quickly and who handled shift pressure — none of which an interview reveals.

Operations that plan conversion from the outset enter the next cycle with a known, trained base and a smaller hiring requirement. Those that treat peak staff as disposable pay the training cost again every year.

Follow-up continues through the engagement and reports early departures by cause. In peak operations these are overwhelmingly commute and shift related — which is to say, fixable in the job design rather than in the selection.
