The HR leader of a Brazilian operation does a job that in many head offices is split between HR, legal and payroll. Underestimating that is the most common reason the role is scoped wrongly from abroad — and the consequences take years to surface.

Union relations are continuous, not occasional

Collective bargaining in Brazil is an ongoing activity. Collective agreements are negotiated by category and territorial base, and they set minimum pay, working time, additional payments and specific conditions. A company operating in several municipalities is typically covered by more than one.

Negotiation experience is therefore a genuine requirement rather than a nice-to-have, particularly in industry, retail, logistics and healthcare. Someone who has never sat at that table will learn during your first negotiation, and the cost of learning is the agreement.

Labour claims are a normal cost of operating

Brazil has a dedicated labour court system and employment claims are common — including from former employees of companies that believe they run a compliant operation. This is not a sign of mismanagement; it is a background condition that competent HR leadership manages actively.

What matters when hiring is whether the person treats it as such: whether they can describe the exposure they inherited in a previous role and what they did about it, and whether documentation discipline is habit rather than policy. Confirm the specifics of your own exposure with Brazilian counsel — but hire someone who will raise it before you ask.

Payroll administration and people strategy are different skills

Brazilian practice distinguishes departamento pessoal — payroll, admissions, terminations, statutory filings — from strategic HR. Both sit under the same director, and professionals who are genuinely strong at both are scarcer than the market suggests.

Decide which one your operation actually needs first. A new or recently restructured entity usually needs compliance depth before organisational development; an established one with a clean base usually needs the opposite.

Finally, assess whether the person can hold a position against a foreign parent. An HR director who only implements headquarters policy will apply frameworks that do not fit Brazilian employment law, and the entity carries the consequence. Follow-up continues for 90 days.
